1. General Provisions

1.1. Contest Organizer

The #builtwithwebforj Contest (hereinafter referred to as the “Contest”) is organized and conducted by BASIS International Ltd. (hereinafter referred to as the “Organizer”). The Organizer reserves the right to adjust the terms of participation at any time if necessary. Participants will be notified of any changes via email or the official contest website no less than 14 days before such changes take effect.

1.2. Eligibility

Participation in the Contest is open to all natural persons who have reached the age of 18 and have a GitHub account. Employees of the Organizer and their direct relatives are excluded from participation. Eligibility may be subject to restrictions based on local laws and regulations. It is the participant’s responsibility to ensure compliance with their country’s legal requirements, including but not limited to trade sanctions and local contest participation laws.

1.3. Acceptance of the Terms

By registering for the Contest, the participant fully accepts these terms of participation. Violations of these terms may result in disqualification.

The Organizer reserves the right to change, adapt, or supplement the Contest or these terms for objective reasons, especially in the event of changes in legal or technical requirements. Changes will be published on the official Contest website.

2. Participation in the Contest

2.1. Registration and Participation Process

Participation in the Contest follows these steps:
Registration: Participants register via the provided online form by entering their full name, a valid email address, and their GitHub username.
Project Development: After registration, participants develop their project using the webforJ framework according to the contest rules.
Project Submission: The final submission is made via the Contest portal with the complete source code on GitHub.
Bonus Points: Participants can earn additional points by sharing a project screenshot on LinkedIn with the hashtag #builtwithwebforj.
Participants must provide correct and complete information, including a valid email address, GitHub username, and (upon request) their full name and address for prize shipping. The Organizer reserves the right to verify the authenticity of provided information and disqualify participants for submitting false or misleading data.

2.2. Submission Requirements

Submitted projects must meet the following criteria:
Use of the webforJ framework as an essential part of the application.
Compliance with the specified evaluation criteria, including appearance, usability, innovation, performance, and complexity.
Submission of the complete source code on GitHub with comprehensible documentation.
No use of copyrighted content without appropriate permission.

2.3. Usage Rights of Submitted Projects

By participating, the participant grants the Organizer a non-exclusive, royalty-free, worldwide, and perpetual right to use the submitted project solely for the purpose of reporting, marketing, and presenting the Contest and the webforJ framework. This usage right does not transfer ownership of the submission or restrict participants from using or commercializing their projects independently.
The participant confirms that they have all necessary rights to their contribution and do not violate any third-party rights. If the Organizer is held liable by third parties for rights violations, the participant shall indemnify the Organizer from any resulting claims.

2.4. Prohibited Content and Disqualification

Submissions must meet a basic quality standard and go beyond simple demonstrations like “Hello World.” The Organizer reserves the right to review submissions and exclude those that do not meet the requirements.
Additionally, the following content is not permitted:
Content that violates applicable law or third-party rights.
Defamatory, offensive, or discriminatory content.
Malware, viruses, or other harmful software.

2.5. Withdrawal from the Contest

Participants may withdraw from the Contest at any time by notifying the Organizer in writing. Already submitted projects will not be considered in this case.

3. Evaluation of Submissions and Winner Selection

3.1. Evaluation Criteria

The submitted projects will be evaluated by an expert jury based on the following criteria:
Appearance: Design quality and visual appeal of the user interface.
Usability: Intuitive operation and user experience of the application.
Innovation: Creativity and originality of the project.
Performance: Efficiency and speed of the application.
Complexity: Technical challenges and solutions implemented within the project.

3.2. Jury Decision Process

The jury, consisting of experts from the Organizer, will evaluate the submissions according to the above criteria. Their decision is final and not subject to appeal. However, participants may request feedback on their submissions, though they acknowledge that this does not grant them the right to challenge the jury’s decision. The Organizer reserves the right to disqualify submissions that do not meet the requirements or violate the terms of participation.

3.3. Announcement of Winners

The winners will be announced after the evaluation phase via the official contest website and notified by email. The Organizer reserves the right to publish the names of the winners for marketing purposes.
If a winner does not respond within 14 days of notification or does not provide their complete address, the entitlement to the prize will be forfeited and an alternate winner will be selected.

4. Prizes and Eligibility

4.1. Prize Overview and Details

The prizes for the contest winners are as follows:
1st Place: MacBook Pro
2nd Place: AirPods Max
3rd Place: Lego Set
4th – 10th Place: Tech accessories & gift cards
The prizes for the top three winners are significantly higher in value compared to the remaining winners. The Organizer reserves the right to provide similar or equivalent alternatives if the stated prizes are unavailable due to unforeseen circumstances.
Participants are solely responsible for any taxes, customs duties, or other fees associated with the receipt of their prize. The Organizer will not cover additional costs related to prize acceptance, such as import duties or local taxation.

4.2. Conditions for Receiving Prizes

To be eligible for a prize, participants must:
Submit a complete project that meets the participation requirements within the submission deadline.
Provide their full name and complete address for prize delivery.
Fulfill all necessary legal requirements for the prize award.
Confirm the prize acceptance within 14 days of the official announcement.
Failure to meet these requirements will result in the forfeiture of the prize and an alternate winner will be selected.

4.3. Prize Delivery

Prizes will be shipped to the address provided by the winner. Participants must ensure their shipping information is accurate. Incomplete or incorrect details may lead to the loss of the prize entitlement.
The Organizer will make reasonable efforts to redeliver prizes returned due to shipping issues, provided the participant supplies corrected details. However, the Organizer is not responsible for additional shipping costs or irrecoverable losses caused by third parties (e.g., shipping service providers).

4.4. No Cash Payout or Prize Transfer

Prizes cannot be exchanged for cash or alternative items. Prizes are non-transferable and cannot be assigned to third parties.

4.5. Contest Cancellation Reservation

The Organizer reserves the right to cancel the contest if an insufficient number of participants register or unforeseen circumstances arise. In such cases, there is no entitlement to the announced prizes. Participants will be informed in a timely manner in the event of a cancellation.

5. Disclaimer and Warranty

5.1. Participant Responsibility

Participants are fully responsible for the content of their submitted projects. They guarantee that their submissions are free of third-party rights and do not violate any laws or regulations. Participants must ensure that any third-party code included in their submissions is appropriately licensed and does not impose restrictions on the Organizer's usage rights. The use of open-source code with restrictive licenses (such as GPL) that would require the Organizer to release proprietary modifications is strictly prohibited.

5.2. Organizer Liability

The Organizer is not liable for direct or indirect damages arising from participation in the contest, including but not limited to:
Technical malfunctions or failures,
Loss or corruption of data,
Unforeseen delays or changes in the contest process.
The Organizer shall only be liable for damages resulting from intentional or grossly negligent conduct.

5.3. Technical Errors and Force Majeure

The Organizer assumes no responsibility for technical issues that result in delayed or unsuccessful participation. This includes, but is not limited to:
Internet or server outages,
Software errors or incompatibilities,
Force majeure events beyond the Organizer's control, such as natural disasters, pandemics, or governmental orders.
In such cases, the Organizer reserves the right to extend, postpone, or cancel the contest.

6. Data Protection Provisions

6.1. Collection and Processing of Personal Data

The Organizer collects and processes participants' personal data solely for the purpose of conducting the contest. This includes:
Name and email address at registration,
Full name and address for prize shipping,
GitHub username for identification and verification of participation.
Data processing is carried out in compliance with applicable data protection laws, particularly the General Data Protection Regulation (GDPR).

6.2. Purpose of Data Processing

The collected data will be used for the following purposes:
Managing contest participation,
Communicating with participants,
Shipping prizes to winners,
Providing information on contest progress and important updates.
Any further use of the data will only take place with the explicit consent of the participant.

6.3. Disclosure to Third Parties

Personal data will generally not be disclosed to third parties, except where necessary for the execution of the contest (e.g., shipping providers for prize delivery).
The Organizer will not sell or otherwise market data to third parties for advertising purposes.

6.4. Data Retention and Deletion

Personal data collected will only be retained for as long as necessary to conduct the contest. After the contest concludes and prizes are awarded, data will be deleted within 90 days unless legal retention obligations apply. Data will be deleted using secure methods such as encryption or anonymization, ensuring compliance with GDPR.

Additionally, participants have the right to lodge a complaint with the relevant data protection authority if they believe their data is being processed unlawfully.

7. Copyright and Usage Rights

7.1. Participant's Rights to Their Submission

Participants retain all rights to their submitted projects, including the source code and associated content. Submitting a project as part of the contest does not transfer ownership rights to the Organizer.

7.2. Granting of Usage Rights to the Organizer

By participating in the contest, the participant grants the Organizer a non-exclusive, royalty-free, perpetual, and worldwide right to use the submitted project for the following purposes:
Public relations and marketing related to the contest,
Display on the contest website and social media platforms,
Presentation at events, webinars, or other communication channels of the Organizer.
This usage right applies solely to the promotion and presentation of the contest and the webforJ framework. Commercial use by the Organizer is excluded unless explicitly agreed otherwise.

7.3. Publication of Winning Projects

The Organizer reserves the right to publish the winning projects across various media platforms, including but not limited to:
The official contest website, the Organizer's social media accounts, press releases or industry publications.
By participating, the participants agree that their submitted projects may be publicly presented and associated with their name or GitHub username.

7.4. Third-Party Rights

Participants guarantee that their submitted projects are free from third-party rights and do not infringe on any intellectual property rights (e.g., copyrights, trademarks, patents). If the Organizer is held liable by third parties for rights violations, the participant shall indemnify the Organizer from any resulting claims.

8. Exclusion of Participants

8.1. Reasons for Exclusion

The Organizer reserves the right to exclude participants from the contest if they:
Provide false or incomplete information during registration.
Submit content that violates applicable laws or third-party rights.
Submit software containing malware, viruses, or security vulnerabilities.
Attempt to manipulate the contest by artificially increasing their reach or gaining advantages through unfair methods.
Engage in multiple registrations or identity fraud.
Do not meet the basic quality standards required for submission.
Submissions must demonstrate practical application of the webforJ framework and meet the evaluation criteria outlined in Section 3.1. Simple "Hello World" projects or non-functional prototypes will not be accepted.

8.2. Consequences of Exclusion

An exclusion from the contest results in:
The participant losing eligibility to participate or claim prizes,
The revocation of any already received awards or points,
A permanent ban from future contests.
In the event of exclusion, the participant is not entitled to any reimbursement of costs or expenses related to contest participation.

9. Early Termination of the Contest

9.1. Reasons for Early Termination

The Organizer reserves the right to terminate or suspend the contest prematurely if:
An insufficient number of participants register to ensure fair competition.
Unforeseen technical issues arise that make proper execution impossible.
Force majeure events occur that are beyond the control of the Organizer.
Manipulation or other violations of the contest terms threaten the integrity of the contest.
If the contest is terminated prematurely, participants will not be entitled to the announced prizes or any other compensation. Participants will be informed in a timely manner about any termination or significant changes. The Organizer will not reimburse participants for any expenses incurred in connection with contest participation.

9.2. Participants' Rights in Case of Termination

In the event of the contest’s premature termination, participants shall have no legal claims against the Organizer, particularly no claims for damages or compensation for efforts already made.
The Organizer will endeavor to offer alternative opportunities or future participation options if feasible.

10. Final Provisions

10.1. Governing Law and Jurisdiction

The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If the participant is a business entity, a legal entity under public law, or a special public fund, the exclusive place of jurisdiction for all disputes arising from or in connection with this contest shall be the Organizer's registered office.
This does not affect mandatory consumer protection laws in the participant’s country of residence, where applicable.

10.2. Severability Clause

If any provision of these terms of service is found to be invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the original provision.
In the event of ambiguities or conflicts within these terms, the Organizer shall have the sole right to interpret and resolve such conflicts.
